1. Agreement
By booking accommodation or using our website at www.talltreesmotel.com.au (“the Website”), you agree to these Terms & Conditions (“T&Cs”). These T&Cs apply in addition to any other rules, conditions or notices displayed at the motel or communicated at check-in.
2. Bookings & Payments
2.1 Rooms are reserved when a booking is confirmed and payment (or deposit) is received in accordance with the payment instructions we provide.
2.2 Rates are per room per night, are inclusive of GST (unless otherwise stated), and exclude any incidental charges (such as mini-bar, damage, late checkout etc).
2.3 We reserve the right to adjust rates at any time, but any confirmed booking will be honoured at the rate confirmed at the time of booking (subject to the cancellation policy below).
2.4 We accept payment by the methods indicated on the Website or at the time of booking.
3. Check-in / Check-out
3.1 Standard check-in time is from 2 pm and check-out is by 10 am, unless otherwise agreed.
3.2 Early arrival or late departure may incur additional charges and is subject to availability.
3.3 A valid photo ID and a credit card (or equivalent) may be required at check-in as security for incidentals.
4. Cancellation, No-show & Amendment Policy
4.1 Bookings may be cancelled or amended in accordance with the policy detailed at the time of booking.
4.2 If you fail to arrive (“no-show”) without prior cancellation, we may charge the full cost of the booking or as per the no-show fee specified at booking.
4.3 If you amend the booking (dates, room type, number of guests) this may incur additional charges or differing rates.
4.4 We reserve the right to cancel or amend your booking in exceptional circumstances (e.g., facility closure). In such case we will notify you and, where possible, offer alternative accommodation or a refund.
5. Occupancy & Use of Rooms
5.1 The number of persons occupying a room must not exceed the maximum number specified for that room type.
5.2 You are responsible for the behaviour of all guests in your party. We reserve the right to refuse service or require departure of guests displaying anti-social or unsafe behaviour.
5.3 Use of the room and facilities is subject to any house rules, signage and direction of motel management.
5.4 Smoking is strictly prohibited inside rooms and indoor public areas unless otherwise designated; any breach may incur cleaning fees.

5.5 Pets are not permitted unless previously approved in writing (and any additional fees or terms apply).
6. Damage, Loss or Extra Charges
6.1 You agree to pay for any damage, loss or extra cleaning required as a result of negligence, misuse or breach of these T&Cs.
6.2 We may charge your card (or hold a deposit) to cover such costs in accordance with your booking agreement.
6.3 We are not responsible for loss, theft or damage of your personal property unless due to our negligence; you should arrange your own insurance for valuable items.
7. Website & Online Bookings
7.1 The Website aims to display accurate content (room types, facilities, rates). However, we do not warrant that the Website is error-free, uninterrupted or free of malware.
7.2 We may update or amend the Website, rates or availability at our discretion.
7.3 When booking online you agree to provide correct, current and complete personal details, and you consent to us using those details for the booking, communication and payment processing.
7.4 You must not use the Website for unlawful purposes or attempt to interfere with its operation or security.
8. Privacy & Personal Information
8.1 We collect, store and use your personal information in accordance with our Privacy Policy (link provided on the Website).
8.2 By providing your details you consent to such collection, storage and use for booking, marketing (if opted-in) and service improvement.
8.3 We will not share your personal information with third parties except (i) as required to fulfil the booking (iii) as required by law or (iii) as set out in our Privacy Policy.
9. Limitation of Liability
9.1 To the fullest extent permitted by law, we exclude liability for any indirect, incidental, special or consequential losses arising from your booking, stay, use of the Website or any services.
9.2 Our liability for direct losses caused by our negligence is limited to the amount paid by you for the accommodation booked.
9.3 Nothing in these T&Cs excludes or limits liability that cannot be excluded by law (for example, under the Australian Consumer Law).
10. Acts of Nature & Force Majeure
We will not be liable for failure to fulfil our obligations under a booking if that failure is due to circumstances beyond our reasonable control (including fire, flood, storm, pandemic, government action, civil disturbance). In such event we will, where possible, offer an alternative date or a refund of amounts paid (excluding our reasonable costs).
11. Intellectual Property
All content on the Website (text, photos, logos, graphics) is our property or used with permission, and is protected by copyright and other intellectual property laws. You may not reproduce or use such content without our prior written consent.
12. Governing Law & Jurisdiction
These T&Cs are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising under these T&Cs.
13. Severability & Waiver
If any provision of these T&Cs is found to be invalid or unenforceable, that provision shall be severed to the minimum extent necessary and the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
14. Amendments
We may update or amend these T&Cs from time to time. The version published on the Website at the time you book will apply to your booking.
